Social Security Disability

Social Security Disability is a government benefit offered to those individuals that can no longer work. Social Security Disability, “SSD”, is awarded based on an individual’s past earnings, when he or she last worked, and their relevant medical history. Providing a complete and through medical history is a crucial step in qualifying for SSD benefits. The legal fee for representing an individual applicant is regulated by Social Security, and there is no fee unless your application for benefits is approved. I work with individuals that are considering applying for Social Security Disability benefits, or those who have already been denied benefits but would like to proceed to the next stage of the Social Security Disability review process. If a hearing regarding your application is required before an Administrative Law Judge, I will prepare a brief in support of your application, inform you of what to expect at the hearing, and attend the hearing with you. I will square away relevant medical documentation and present it in an organized fashion that corresponds to the applicable listing criteria.

A first way to qualify for SSD benefits is to demonstrate that an applicant qualifies under Social Security’s own medical listing criteria. In order to prove this I will request copies of your medical records, and sometimes ask your doctors to fill out additional forms, so that a clear and concise presentation of medical evidence is made in support of your application. Special attention and a review of Social Security publications also may be necessary to show that your illness, or a combination of ailments, qualify you for benefits. If the medical condition itself does not meet the listing criteria, an individual still may qualify for benefits if he or she lacks a residual work capacity.
