To protect a workers’ compensation claim an individual needs to file a Form 30C with the proper workers’ compensation venue within one year of the accident. While there are a few exceptions to the required one year time period, the filing of the form, with a description of all body parts impacted by the accident, is the best way to preserve the right to benefits. The method of filing the Form may also vary depending on the employer and the employer’s location.
After initiating workers’ compensation proceedings, medical care should be provided, and lost wages should be reimbursed by the employer’s insurer. Often, however, a series of informal and formal proceedings are required before a workers’ compensation commission to establish the right to benefits. Thereafter, the benefits may change during your recovery and as the result of information provided by a doctor. After you have recovered, a final settlement of your claim may be explored, and payment provided for any applicable permanent injury rating.
